A conviction for a first time misdemeanor DUI can carry penalties that include:
- Up to $1,000 in fines
- 3 years of informal probation
- 3 to 9 month mandatory DUI program
- 6 to 10 month drivers’ license suspension
- Up to 6 months in jail (in Sacramento, this will likely be 48 hours of actual jail time)
The $1,000 fine does not include penalty assessments and court fees, which can more than triple the fine amount. The license suspension can generally be converted into a restricted license in most circumstances, after 30 days following an administrative suspension.
Administrative License Suspension for DUI Offenses
When a person is convicted of DUI, the Department of Motor Vehicles (DMV) will seek an administrative suspension of their drivers’ license, which is separate from the suspension triggered by a criminal court. The person is able to partake in a DMV hearing in an effort to reclaim their driving privileges, but they must request the hearing within 10 days of their arrest. They are also able to have representation in the form of criminal defense attorney at the hearing.
