What Is an Ignition Interlock Device?

Sentencing in a DUI case can include mandatory installation of an ignition interlock device (IID). An IID is installed on the steering column of a car and acts as a smaller version of a breathalyzer. The vehicle operator will not be able to start their car without blowing into the device. If the IID detects alcohol on the driver’s breath, the car will be inoperable. A driver will also need to periodically blow into the device while driving their vehicle to ensure no alcohol was consumed while on the road.
An IID must be installed by a professional at your expense and on all of your vehicles. It will record the breath test results, as well as the times the car is started and stopped. Any efforts to disable the device will also be noted by the system. A new pilot program in Sacramento now mandates that even first time DUI offenders must install an IID on their vehicles. How long the device must be used will vary depending on the case, and can include:
- 5 months – first time DUI
- Up to 1 year – a DUI resulting in an accident with injuries.
- Up to 3 years – refusal to submit to a breath or blood test
IID and Other DUI Penalties
A conviction for drunk driving can result in jail time, fines, mandatory alcohol treatment, court-ordered installation of an IID and license suspension. The severity of the sentencing will depend on the defendant’s prior DUI history, if the DUI result in an accident with injuries, and the person’s blood alcohol content.
